Fireflai (“we” or “us”) thanks you (“the Buyer”) for your interest in preordering our product (the “Preorder”). By purchasing Fireflai preorder offering on https://fireflai.co/preorder/ you accept the following Fireflai Preorder Terms and Conditions (the “Terms and Conditions”).

Preorder Purchase and Refund

This special offer is only available to the first 50 purchases and till 1st November 2022.

For a price of CHF 9.00, the Preorder includes a full access to our minimum viable product (“MVP”) available for release in November 2022 that includes the chapter 1 of our self-esteem island (“Lighten Up”); along with the additional 4 chapters that completes the self-esteem island: “Coping”, “Self-Comparison”, “Self-Efficacy” and “Self-Awareness”. (Original value: CHF 99).

The Buyer is able to purchase the Preorder through a secured paywall powered by Stripe and is able to claim a refund of the purchase anytime after the purchase and prior from downloading and creating an account with Fireflai‘s MVP. In the unlikely event that Fireflai is unable to release their additional 4 chapters, Fireflai is not bound to refund the Buyer’s payment if that the Buyer has already created an account with Fireflai through this Preorder offering.

Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT FIREFLAISHALL NOT BE LIABLE TO YOU OR ANY THIRD – PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL AND/OR EXEMPLARY DAMAGES INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR PAIN AND SUFFERING, PERSONAL INJURY/WRONGFUL DEATH, LOSS OF INCOME, LOSS OF CONSORTIUM, BUSINESS INTERRUPTION, OR DAMAGES FOR LOSS OF PROFITS, GOODWILL, LOSS OF DATA OR OTHER INTANGIBLE LOSSES (EVEN IF FIREFLAI HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). TO THE FULLEST EXTENT PERMISSIBLE BY LAW, FIREFLAI ALSO SHALL NOT BE LIABLE TO YOU OR ANY THIRD – PARTY FOR:

  1. THE USE OR THE INABILITY TO USE THE FIREFLAI PREORDER OFFERINGS;
  2. THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION, CONTENT AND /OR ANY OTHER FIREFLAI HEALTH PRODUCTS AND/OR SERVICES PURCHASED OR OBTAINED FROM OR THROUGH THE FIREFLAI HEALTH PREORDER OFFERINGS, MEMBER CONTENT AND/OR MEMBER CONTENT;
  3. THE FAILURE TO REALIZE ANY SPECIFIC HAPPINESS, MENTAL HEALTH, PSYCHIATRIC OR OTHER BENEFIT OR RELATED OUTCOME; AND
  4. ANY OTHER MATTER RELATING TO THE FIREFLAI PREORDER OFFERINGS, AND/OR ANY OTHER FIREFLAI PRODUCTS AND/OR SERVICES.

THIS LIMITATION APPLIES TO ALL CAUSES OF ACTION, IN THE AGGREGATE INCLUDING, BUT NOT LIMITED TO, SECURITIES LAW VIOLATIONS, BREACH OF CONTRACT, BREACH OF WARRANTY, NEGLIGENCE, STRICT LIABILITY, MEDICAL AND OTHER MALPRACTICE, MISREPRESENTATION AND ANY AND ALL OTHER TORTS. YOU HEREBY RELEASE FIREFLAI FROM ANY AND ALL OBLIGATIONS, LIABILITIES AND CLAIMS IN EXCESS OF THE LIMITATIONS STATED HEREIN. NO ACTION, REGARDLESS OF FORM, ARISING OUT OF YOUR USE OF THE FIREFLAI OFFERINGS, MEMBER CONTENT AND/OR ANY OTHER FIREFLAI PRODUCTS AND/OR SERVICES MAY BE BROUGHT BY YOU OR FIREFLAI MORE THAN ONE (1) YEAR FOLLOWING THE EVENT WHICH GAVE RISE TO THE CAUSE OF ACTION. THE NEGATION OF DAMAGES SET FORTH ABOVE IS A FUNDAMENTAL ELEMENT OF THE BASIS OF THE BARGAIN BETWEEN YOU AND FIREFLAI . ACCESS TO FIREFLAI OFFERINGS, MEMBER CONTENT AND/OR ANY OTHER FIREFLAI PRODUCTS AND/OR SERVICES WOULD NOT BE PROVIDED TO YOU WITHOUT SUCH LIMITATIONS.

YOU MUST AFFIRMATIVELY CONSENT TO USE OUR OFFERINGS, AND BY DOING SO, YOU CONSENT TO THESE TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO OUR TERMS AND CONDITIONS, INCLUDING OUR PRIVACY POLICY, IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR OTHERWISE USE THE SERVICES, CONTENT (AS THAT TERM IS DEFINED BELOW), PROMOTIONS OR SITE IN ANY MANNER OR FORM WHATSOEVER.
